There is a liability trial set for October 2025. Plaintiffs have been randomly selected by both plaintiff attorneys and defendants to represent specific areas effected by the DOW Chemical spill. These selected plaintiffs are currently completing written discovery and depositions.
By the end of the month, the trial plaintiffs will be limited to 8 chosen by plaintiff counsel and 16 chosen by defense counsel. These selected plaintiffs will testify at trial regarding their personal experience and knowledge of the incident in July 2009, which will include, where they were located at the time and any injury or illness experienced caused by the chemical exposure in July 2009.
